These Terms of Service (“Terms”) govern your access to and use of this website, its related services and any products offered (“we”, “our”, “us”). By accessing or using our site or purchasing our products, you agree to be bound by these Terms. If you do not agree, you must not use our site or services.

2. Products and Services

We provide specialized monitoring tools (the “Software”). Product descriptions are provided for informational purposes. While we strive for accuracy, we do not warrant that the Software will be compatible with all versions of third-party platforms (e.g. SAP HANA or Zabbix). We reserve the right to modify, suspend or discontinue any product at any time.

3. Orders and Payment

  • All prices are listed in the currency indicated on the site.
  • Full payment is required via our authorized payment processor before delivery of any paid licenses or features.
  • You are responsible for any taxes or fees that may apply to your purchase.
  • We reserve the right to change our prices. Any price changes will take effect only upon your next scheduled renewal. Continued use of the Software after a renewal constitutes acceptance of the new price.

4. Refund Policy

We do not offer refunds on purchased licenses. Because our Software is a digital product delivered instantly, once a purchase is completed, it is considered final and non-refundable. To ensure the Software meets your requirements, we provide a time-limited, fully-featured trial license upon request. We strongly encourage testing your specific environment during the trial period before purchase.

5. Licensing and Fair Use

The Software is licensed, not sold. We offer two license types:

  1. Free Version – A limited, non-exclusive license to use a restricted feature set.
  2. Paid Site License – A non-exclusive, non-transferable license to use the full Software functionality.
    • Scope: This license covers an unlimited number of instances and devices owned and operated internally by your organization (the purchasing legal entity).
    • Restrictions: Use of the Software to provide managed services to third parties, or any form of redistribution or resale, is strictly prohibited without prior written consent.

6. Intellectual Property

All code, graphics, and designs are owned by us. You may not reverse-engineer, decompile or attempt to extract the source code of the Software binary.

7. Prohibited Use

You agree not to use the Software for unlawful purposes, to bypass licensing checks or to distribute the binary to third parties without express written consent.

8. Disclaimers

  • No Warranties: The Software is provided “as is” and “as available.” We disclaim all warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose.
  • Passive Monitoring: You acknowledge that the Software is a passive monitoring tool. We have no control over, and are not responsible for, the administration, configuration, stability or uptime of your SAP HANA or Zabbix environments.
  • User Responsibility: You are solely responsible for verifying compatibility with your specific environment using the provided trial period. We do not warrant that the Software will be error-free or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or the use of the Software—whether in contract, tort or otherwise—is limited to the total amount actually paid by you to us during the twelve (12) months immediately preceding the event giving rise to the claim. We are not liable for any loss of data, lost profits or system downtime.

10. Changes to These Terms

We may update these Terms to reflect changes in our products or legal obligations. Your continued use of the Software following an update signifies your agreement to the revised Terms.
